August 2021 - Alert - New ASTM Phase I ESA Guidelines Expected this Year!

New American Society for Testing and Materials (ASTM) standards for conducting Phase I Environmental Site Assessments (ASTM E1527) are on the way! Phase I Environmental Site Assessments (commonly referred to as Phase Is or ESAs), when performed in accordance with ASTM standards, can provide protection from environmental liabilities to landowners and prospective purchasers (the “innocent landowner” defense) under federal law, specifically the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Landowners and prospective purchasers should be on the lookout for the updated standard (E1527-21) later this year. Performing a Phase I ESA in accordance with the current ASTM standard satisfies the requirements of “All Appropriate Inquiry.”

PHE would like to congratulate Kevin Johnson and the rest of the staff of the Marine Corps Air Station Camp Pendleton Environmental Department for their selection as a Secretary of Defense Environmental Award winner for 2021, in the category of Environmental Quality - Industrial Installation! This award comes on the heels of the Department’s selection in the same category for the 2021 Secretary of the Navy Environmental Awards competition. Kevin sits onsite in the Environmental Department in support of the Air Station’s environmental training program, which PHE has supported since 2007.

November 2020 - NEPA Modernization:  A Look at the Act’s First Makeover in Forty Years

The Council on Environmental Quality (CEQ) recently announced significant revisions to its National Environmental Policy Act (NEPA) regulations, which govern how NEPA is implemented across the Federal government. These changes represent the first major update to NEPA regulations in over 40 years. The new regulations went into effect on September 14, 2020 and agencies will have 12 months to update their NEPA regulations. While the goal of these changes is to streamline NEPA processes and provide additional flexibility to agencies, at least in the short term there may be some growing pains as agencies and NEPA practitioners adapt to the new requirements.

August 2020 - PHE Wins Another Contract with the United States Army Corps of Engineers!

PHE, along with our joint venture partner Michael Baker International, was recently awarded a third indefinite delivery, indefinite quantity (IDIQ) contract with the U.S. Army Corps of Engineers (USACE) Mobile District! The latest award is a Small Business contract to provide environmental planning services, with contract capacity of $40 million. Through this contract, PHE and Baker will support the USACE Mobile District’s Planning and Environmental Division to provide solutions to complex environmental planning needs.
